May 13, 2014— --A pharmaceutical company, Merck, says it will pay more than $1 billion for its drug for the heartburn drug Crestor in the United States.
The Food and Drug Administration will pay $2.6 billion to help Merck get a deal for Crestor, the active ingredient in Crestor, in 2014.
Merck paid $1.4 billion to help the company get a deal for Crestor, which is sold as a generic version of Lipitor, which the drug maker had been marketing since 2011.
The company's other drugs are now sold in the United States as a cheaper generic version of Lipitor and its generic version of Crestor, and as "generic" versions of AstraZeneca's drug, Crestor.
"This is a highly complex issue that needs to be dealt with," said David T. Schulze, the acting head of the FDA's Center for Drug Evaluation and Research in Washington, D. C. "We have an obligation to keep a drug with the correct active ingredients at our disposal."
Tobacco smoke is not a problem for Merck, but it has a negative impact on the U. S. drug market and could pose a serious threat to the market for Crestor.
"This is just a marketing issue," said Merck spokesman Dan Schentag, "but we are talking about drugs that are being marketed as cheaper alternatives to Lipitor."
Crestor, which is being sold under the name Claritin, is being sold by AstraZeneca under a different name, to treat high cholesterol. Crestor has been approved by the FDA for use in the United States, and was approved for use in the European Union and the United Kingdom by the end of 2010.
The agency had previously rejected the drug because it did not have "potential side effects" or the risks were too great.
AstraZeneca has been marketing Crestor for years under the name Crestor. Last year, AstraZeneca's U. sales were $2.8 billion and Crestor had a market share of 32%.
In 2010, Crestor was approved by the FDA, and AstraZeneca's Crestor had a market share of 26%.
The U. market for Crestor is estimated at about 30%, and the U. K. market for Crestor is estimated at 30%.
In 2013, AstraZeneca announced that it had filed a lawsuit to invalidate a $9.5 billion US civil settlement with the FDA in the wake of the FDA's decision. The complaint, filed with the FDA, alleged that the FDA had failed to adequately warn consumers of the possible risks of Crestor and to warn about the dangers of Crestor.
The lawsuit was filed in New Jersey federal court, which was scheduled to hear arguments on Oct. 8. The FDA's lawsuit is based on the same allegations that AstraZeneca had misled consumers by failing to warn of the potential risks.
The suit seeks to halt a massive campaign by the pharmaceutical industry to block Crestor from being approved by the FDA and to force Crestor manufacturers to add new active ingredient ingredients to their labels. The FDA is already considering the complaint.
The suit, filed in the U. District Court for the District of Delaware, claims that AstraZeneca misled consumers by not warning of the risks of Crestor.
The lawsuit, filed in the U. District Court for the District of New Jersey, alleges that AstraZeneca's conduct led to the "inadvertence of the company's competitors" and that "the company intentionally omitted to warn consumers of the potential risks of Crestor and other competing drugs in the form of false, misleading, deceptive and misleading statements."
The complaint also claims that the company misled the FDA by failing to adequately warn about the risks of Crestor.
The suit also alleges that the company misled consumers by failing to warn that Crestor is not a generic and that Crestor is a cheaper alternative to Lipitor.
The company also failed to give adequate warnings about the potential risks of Crestor.
AstraZeneca has been under investigation by the FDA for alleged failure to adequately warn consumers about the potential risks of Crestor.
The complaint alleges that AstraZeneca misled consumers about the risks of Crestor and made misleading and deceptive statements about Crestor.
